ASX is introducing a number of minor amendments to Schedule 10A (AQUA Products and the AQUA Trading Market) of the ASX Operating Rules and Procedures

The amendments relate to:

• Approval of AQUA Product Issuers – updating the types of entities that may be AQUA Product Issuers.
• Approval of AQUA Products – updating the requirements for admission in regards to underlying instruments admitted to trading on a Non-ASX Market
• Removing the application form for Admission to Trading Status from the ASX Operating Procedures. The form will now be as specified by ASX from time to time.
• A new requirement that an AQUA Product must be a CS Approved Product and removing provisions dealing with paper-based transfers that are only relevant where AQUA Products are not CS Approved Products
• Updating the Indemnity and No Guarantee of Viability provisions of the ASX Operating Rules.
• Updating the disclosure requirements for AQUA Products having to be detailed in the product disclosure statement or prospectus

What do I need to do by when?

Product Issuers should read the attached ASX Operating Rule and Procedure amendments to understand the new requirements and introduce any processes or procedures into their organisations so as to be compliant with them.
